In a recent development, the High Court in Accra dismissed the case filed against First Atlantic Bank by Deborah Sayram Adablah, a former National Service Person, who had accused the bank’s former Chief Finance Officer, Ernest Kwasi Nimako, of sexual harassment.
Justice Olivia Obeng Owusu presided over the case and ruled in favor of First Atlantic Bank, removing them from the case and ordering Adablah to pay compensation of GH¢6,000 to the bank. Initially, the bank’s lawyers requested GH¢50,000, while the plaintiff offered GH¢5,000.
Adablah had dragged both Ernest Kwasi Nimako and the bank to court, alleging sexual harassment and other claims. However, the court decided to strike out the bank’s name from the case.
In another motion filed by Adablah’s lawyers on June 15, 2023, they sought to set aside the court’s ruling for execution and requested an order for the preservation of a disputed vehicle involved in the matter.
Additionally, lawyers representing Kwasi Nimako filed a contempt case against Adablah due to certain publications made after the court had ordered both parties to refrain from doing so.
Background
Adablah who is the plaintiff filed a writ alleging sexual harassment against Ernest Kwesi Nimako, former Chief Finance Officer and the bank.
Following the action, the Bank has requested that its name be withdrawn from the lawsuit filed by the former NSS worker.
In that application dated January 24, this year, the Bank requested that seven paragraphs of the writ be dismissed “on the ground that they disclose no reasonable cause of action against the applicant.”
It contends that Paragraphs 7,8,9,10,11,31,32,33,34,36 and 37 which were requested to be excluded comprise portions of the writ that accuse the bank of watching on for female workers being harassed sexually by senior male officers of the bank.
The substantive case alleging sexual harassment against Kwasi Nimako would be dealt with after this preliminary application.
